Terms of Service

Effective date: October 12, 2026

These Terms of Service (“Terms”) govern your access to and use of the DeedMine platform and API (the “Service”) operated by DeedMine (“we,” “us”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally authorized to enter into contracts to use the Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company.

2. Account Registration

You agree to provide accurate registration information and to keep your API key confidential. You are responsible for all activity that occurs under your account. Notify us immediately at security@deedmine.com if you suspect unauthorized access.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose, including violation of the Fair Housing Act, FCRA, or state privacy laws
  • Use distress scores to discriminate against protected classes
  • Resell or sublicense API access without prior written consent
  • Attempt to reverse-engineer, scrape, or extract underlying data beyond your plan limits
  • Use the Service to send unsolicited communications (spam)
  • Interfere with or disrupt the Service or its infrastructure

4. Property Data Disclaimer

DeedMine aggregates publicly available data. Distress scores are probabilistic estimates, not guarantees of seller motivation, property condition, or market value. You are responsible for independently verifying any property information before making investment decisions. DeedMine is not a licensed real estate broker, appraiser, or financial advisor.

5. Owner Contact Information and Outreach

The Service can show property owners’ names, mailing addresses, phone numbers and email addresses, some of it from third-party data providers. This information can be incomplete, outdated or wrong, and DeedMine does not guarantee it.

How you may use it. You may use owner contact information only to contact owners about buying, selling or otherwise dealing in real estate. DeedMine does not provide consumer reports. You may not use owner contact information, distress scores or any other DeedMine data as a factor in decisions about anyone’s eligibility for credit, insurance, employment, housing or tenancy, or for any other purpose covered by the Fair Credit Reporting Act (15 U.S.C. § 1681b).

You are responsible for your outreach. You alone decide whether, when and how to call, text, email or mail anyone, and you must follow every law that applies to that outreach, including:

  • The Telephone Consumer Protection Act and the FCC’s rules (47 C.F.R. § 64.1200), which among other things restrict calls and texts to cell phones made with an autodialer or an artificial or prerecorded voice without the called party’s prior express consent, restrict telephone solicitations before 8 a.m. or after 9 p.m. in the called party’s local time, and prohibit telephone solicitations to residential numbers on the National Do Not Call Registry unless an exception applies;
  • keeping your own access to the National Do Not Call Registry current and checking numbers against it before you call, as those rules require;
  • the CAN-SPAM Act for marketing email, including identifying the message as an ad, including a valid physical postal address, offering a way to opt out, and honoring opt-outs promptly; and
  • all state and local laws on telemarketing, texting, do-not-call lists and solicitation.

Where the Service marks a number “Do Not Call,” “litigator” or “deceased,” that label comes from a data provider and may be incomplete. It is a convenience, not a substitute for your own compliance. The Call, Text and Email buttons only open your own phone or email app; DeedMine does not place calls or send texts or emails for you. Nothing in the Service is legal advice. Talk to your own attorney about your outreach.

6. Plans, Billing & Trials

Subscription fees are billed monthly via Stripe. 7-day free trials do not require a credit card. After the trial, a payment method is required to continue. Refunds are not issued for partial billing periods. We reserve the right to change pricing with 30 days’ notice.

7. API Key & Rate Limits

Each plan includes a monthly score quota. Exceeding your quota may result in HTTP 429 responses until the next billing cycle or an automatic upgrade prompt. API keys must not be embedded in public client-side code.

8. Intellectual Property

DeedMine retains all rights to its scoring algorithms, platform code, and proprietary data models. You retain ownership of any data you upload. You grant us a limited license to process your data solely to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, DeedMine’s total liability for any claim arising out of these Terms or your use of the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold harmless DeedMine, its officers, directors, and employees from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service in violation of these Terms.

11. Termination

We may suspend or terminate your account for material violations of these Terms, non-payment, or at our discretion with 30 days’ notice. You may cancel your subscription at any time from the Billing page; cancellation takes effect at the end of the current billing period.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Fulton County, Georgia.

13. Changes

We may update these Terms. We will provide at least 14 days’ notice of material changes via email. Continued use after the effective date constitutes acceptance.
